MSME + DPDP FAQ

Does DPDP Act apply to MSMEs? We are small.

Yes. DPDP Act 2023 has no MSME exemption. If your Udyam-registered business collects customer name, phone, email, Aadhaar, GST number, or payment card, you are a Data Fiduciary. The good news: most MSMEs are non-SDF so obligations are lighter than large enterprises — but they are not zero.

What does DPDP compliance cost for a typical MSME?

Do we need a DPO? We have 12 employees.

Almost certainly not. Section 10 mandates DPO only for Significant Data Fiduciaries — a status the Government notifies based on data volume, sensitivity and risk. Micro and Small MSMEs are rarely SDFs. But you still need a published contact person for grievances (Section 5) — the founder or admin can be it.

We use Tally, Zoho Books, Razorpay. How do those fit under DPDP?
