The Codes came in on 21 November 2025. Most employers are still catching up.
Two Gazette notifications on 21 November 2025 brought all four Labour Codes into force and repealed 29 central Acts overnight. The Social Security (Central) Rules 2026 landed on 8 May 2026 with a 22 June 2026 aggregator deadline. The March 2026 MoLE FAQs settled several questions the bare Codes left ambiguous. If you have not read all three, your practice is out of date.
CTCs need restructuring
Section 2(y) of the Wages Code requires at least 50% of remuneration to be "wages" (basic + DA + retaining). Almost every legacy Indian CTC template fails this test. The March 2026 FAQ made it worse by ruling that overtime is in the 50% aggregate.
Aggregators had 22 June 2026
Every aggregator (Ola, Swiggy, Urban Company, and any platform business under Schedule VII) had to link its gig-worker database to e-Shram by 22 June 2026 via live API. Missed deadlines attract 12% p.a. interest on unpaid Section 114 contributions.
Gratuity liability jumped
The March 2026 FAQ clarifies that gratuity for the ENTIRE period of service (including pre-21-November-2025 legacy service) is computed on the new higher wage base. Actuarial revaluations for FY 2025-26 accounts need to reflect this.
