Three Supreme Court rulings have moved the law materially in the last three years.
The POSH Act 2013 has been reshaped by three Supreme Court judgments between 2023 and 2025: Aureliano Fernandes (national audit directions), Vaneeta Patnaik (strict Section 9 limitation and Direct Nexus Test), and Dr. Sohail Malik (expanded workplace and jurisdiction). Plus the Companies (Accounts) Second Amendment Rules 2025 expanded the Board's Report disclosure. If you read only the bare Act, you will give wrong advice.
Aureliano Fernandes (2023)
The Supreme Court recorded "serious lapses" in enforcement after ten years and directed a nationwide audit through State Chief Secretaries plus training modules through NALSA/SLSAs. This is why your Internal Committee needs a demonstrable capacity-building record on file.
Vaneeta Patnaik (2025)
Reaffirmed the strict 3+3-month Section 9 limitation and introduced the Direct Nexus Test. After this ruling, the "continuing wrong" argument is much harder to run. Miscomputing limitation is now a clean ground for challenge.
Dr. Sohail Malik (2025)
Held that an aggrieved woman can approach her own IC even if the respondent is in a different department or organisation. Reiterated the wide reading of workplace under Section 2(o) to include virtual, client sites, field locations, and employer-provided transport.
8 modules. 40 lessons. Every claim cited.
Each lesson combines a plain-English explanation with worked examples using real numbers and a Common mistakes callout at the end. Every Section, Rule, and Ministry position quoted in the course is recorded in the public legal citation register at /courses/posh-act-practitioner/trust.
Foundations
The Vishaka origin story; how the 2013 Act codified 16 years of judicial guidelines; the three Supreme Court rulings that every practitioner must now read alongside the bare Act; the 2025 Companies Act disclosure change; how to read the Act and Rules as one text.
Defining sexual harassment
The five descriptive limbs of Section 2(n); the five circumstances of Section 3 that promote a workplace claim; quid pro quo versus hostile environment; who the Act protects and who it does not; applying the definitions to real-world fact patterns.
Who is bound and where
Sections 2(f), 2(g), 2(a) and 2(o) decide the spine of every case. Identifying the employer in complex group structures, contractor chains, and platform models. The expanded workplace test after Sohail Malik: virtual, hybrid, client-site, field work, transport.
Constituting the Internal Committee
Composition, gender ratio, the external member, tenure, replacement, and what makes a committee defective. The Aureliano Fernandes directions translated into a checklist. Building a member tenure tracker and a fallback bench.
The Local Committee and small establishments
When Local Committee jurisdiction is triggered; how to interface with the District Officer; what employers under 10 employees still have to do; filing a Section 9 complaint with the LC correctly.
Complaint and inquiry
From complaint receipt to the Section 13 report. Time limits after Vaneeta Patnaik and the Direct Nexus Test. Conciliation under Section 10, interim relief under Section 12, and how to run a fair, defensible inquiry under Rule 7.
Outcome, action, and appeal
The employer's Section 13(3) 60-day action window; Section 15 monetary relief computation; Section 14 false-complaint findings without over-reach; Section 17 confidentiality; the Section 18 appellate path.
Employer compliance, disclosure and penalties
The full employer-side compliance build: policy, awareness, training under Rule 13; Section 21 annual report; Section 22 Board's Report disclosure; the Companies (Accounts) Second Amendment Rules 2025 expansion; Section 26 penalty exposure (₹50,000 first offence, doubled on repeat, plus licence cancellation).
Not a summary. Practitioner training.
Citation-anchored content
Every claim links to a Section, Rule, or judgment. The public trust page quotes every source verbatim. Every one of the three Supreme Court rulings is on file with the exact paragraph reference. You can defend anything the course teaches in an inquiry appeal.
20+ worked examples with real numbers
IC constitution scenarios showing valid and defective compositions. Section 9 limitation computation across borderline complaint dates. Section 15 monetary relief on realistic salary scales. Section 22 Board's Report disclosure templates for the new 2025 format.
40 Common mistakes callouts
Every lesson ends with a Common mistakes box listing the specific errors practitioners make on that topic. Constituting an IC without the mandatory external member. Missing the 90-day Section 11 timeline. Confusing false-complaint findings with acquittal. Filing the annual report without the 2025 gender-composition data.

The most current POSH course in India
Content is dated. As of 20 July 2026, the course incorporates:
- The bare text of the POSH Act 2013 (Act No. 14 of 2013) and the POSH Rules 2013.
- Aureliano Fernandes v. State of Goa, Civil Appeal No. 2482 of 2014, decided 12 May 2023.
- Vaneeta Patnaik v. Nirmal Kanti Chakrabarti, 2025 INSC 1106, decided 12 September 2025.
- Dr. Sohail Malik v. Union of India, 2025 INSC 1415, decided 10 December 2025.
- The Companies (Accounts) Second Amendment Rules 2025, effective 14 July 2025, expanding the Board\'s Report disclosure.
Every citation is on the public trust page with a paragraph-level reference. When a Supreme Court or High Court judgment materially moves POSH law, the affected modules are updated and the legal-basis version is bumped.
This course is for professional development. It is not legal advice on any specific complaint, employer obligation, or pending matter. For decisions on a live complaint or a specific compliance question, consult a qualified employment lawyer.
